Please read these terms carefully. They outline the rules, regulations, and your responsibilities when using our platform and purchasing our authentic Kerala products.

1. About These Terms

These Terms and Conditions constitute a legally binding agreement between you ("customer", "you") and Thamaraco Global Foods Private Limited ("we", "us", "our"), a company incorporated in India under CIN U46300KL2025PTC095271, operating the Upperi brand.

We reserve the right to update these terms at any time. The version published on this page at the time of your order or visit applies. Continued use of the website constitutes acceptance of the current terms.

2. Products

2.1 Product descriptions

We take care to ensure product descriptions, images, and nutritional information on our website are accurate and reflect our NABL-accredited lab test data. However, slight variations in appearance between product images and the actual product may occur due to photography and printing processes.

All nutritional information is approximate and provided per 100g and per 30g serving as per FSSAI requirements. Actual values may vary slightly between batches within permitted tolerances.

2.2 Pricing

All prices are listed in Indian Rupees (INR), inclusive of all taxes.

Prices displayed on our website are correct at the time of publication. We reserve the right to change prices at any time. The price you pay is the price confirmed at checkout.

2.3 Product availability

All products are subject to availability. If a product you have ordered is out of stock, we will notify you by email and offer a full refund or an alternative.

3. Orders

3.1 Placing an order

By placing an order on our website or through any authorised channel, you are making an offer to purchase the specified products at the stated price. An order is confirmed only when you receive a written confirmation from us by email.

We reserve the right to refuse or cancel any order at our discretion, including in cases of suspected fraud, pricing errors, or stock unavailability. In such cases, any payment made will be fully refunded.

3.2 Order modifications and cancellations

You may request to cancel or modify your order within 2 hours of placing it, provided it has not yet been dispatched. After dispatch, the order cannot be cancelled. Please email hello@upperisnacks.com immediately with your order number.

3.3 Bulk and trade orders

For bulk or trade enquiries, please contact us at hello@upperisnacks.com. Bulk orders are subject to separate terms and minimum order quantities. Trade discount terms are communicated directly and are not applicable to retail orders placed on this website.

4. Payments

We accept payments through the payment methods listed at checkout. All transactions are processed through secure, PCI-DSS compliant payment gateways. We do not store your card or bank details.

Payment must be made in full at the time of order placement. Orders are processed only upon confirmation of successful payment.

In the event of a failed or disputed transaction, please contact us at hello@upperisnacks.com with your order details. We will resolve payment issues within 5 working days.

5. Shipping and Delivery

5.1 Delivery areas

We currently ship within India. Delivery to certain remote pin codes may not be available. You will be informed at checkout if we cannot deliver to your address.

5.2 Delivery timelines

Standard delivery: 3 to 7 working days from the date of dispatch, depending on your location. Delivery timelines are estimates and may vary due to courier delays, public holidays, or circumstances beyond our control.

We are not liable for delays caused by the logistics partner after dispatch. However, if your order has not arrived within 10 working days of the expected delivery date, please contact us and we will investigate.

5.3 Shipping charges

Shipping charges, if applicable, will be displayed at checkout before you confirm your order. Free shipping thresholds, if offered, will be clearly communicated on the website.

5.4 Risk and ownership

Risk in the products passes to you on delivery. Ownership passes to you on receipt of full payment.

6. Returns and Refunds

Upperi sells packaged food products. Due to the perishable nature of food and hygiene requirements, our returns policy is as follows.

6.1 You are entitled to a replacement or full refund if
  • The product you received is damaged in transit.
  • The product seal is broken or tampered with at the time of delivery.
  • The product you received is different from what you ordered.
  • The product has passed its "Best Before" date at the time of delivery.
  • 6.2 How to raise a return or refund claim

    Contact us at hello@upperisnacks.com within 48 hours of delivery with your order number and a clear photograph of the product, packaging, and the issue you are reporting.

    We will review your claim and respond within 3 working days. Approved claims will be resolved by replacement dispatch or refund to your original payment method within 7 working days of approval.

    6.3 We do not accept returns if
  • The product seal has been broken by you after delivery.
  • The product has been partially consumed (except where the quality issue is reported within the same opening).
  • The claim is raised more than 48 hours after delivery.
  • The reported issue is a matter of personal taste preference.
  • 6.4 Refund method

    Refunds will be processed to the original payment method within 7 working days of approval. For cash-on-delivery orders, refunds will be issued to a bank account provided by you.

    7. Intellectual Property

    All content on this website — including but not limited to the Upperi brand name and logo, product names, photography, packaging design, copy, illustrations, and the "The crunch of home." tagline — is the exclusive property of Thamaraco Global Foods Private Limited or its licensors.

    You may not reproduce, distribute, modify, or use any content from this website for commercial purposes without our prior written consent. Sharing product images on personal social media with appropriate credit to @upperisnacks is permitted and encouraged.

    The brand name "Upperi" and logo are pending trademark registration. Unauthorised use constitutes infringement and will be pursued legally.

    8. Prohibited Uses

    You agree not to use this website to
  • Place false or fraudulent orders.
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity.
  • Engage in any activity that disrupts or interferes with the website or its servers.
  • Scrape, copy, or reproduce any content from this website without permission.
  • Use the website for any unlawful purpose under Indian law.
  • 9. Limitation of Liability

    To the fullest extent permitted by applicable law, Thamaraco Global Foods Private Limited shall not be liable for
  • Any indirect, incidental, special, or consequential damages arising from your use of our products or website
  • Any loss or damage caused by events outside our reasonable control, including natural disasters, strikes, pandemics, or logistics partner failures.
  • Any allergic reactions or health events arising from consumption of our products where the relevant allergen is clearly declared on the product label.
  • Our products carry clear allergen declarations on every pack. It is your responsibility to read the allergen information before consumption. Our products are manufactured in a facility that also handles Nuts, Soya, and Milk.

    Our total liability for any claim arising from a product or order shall not exceed the value of that specific order.

    10. Food Safety and FSSAI Compliance

    All Upperi products are manufactured in compliance with FSSAI regulations. Our FSSAI licence number is 11325999000696 (Marketer) and the manufacturing facility licence is 12416003000281.

    All five SKUs have been independently tested by an NABL-accredited laboratory (Interfield Laboratories, Kochi) across ten FSSAI-mandated nutritional parameters.

    Best Before dates are printed on every pack. Consuming products after the Best Before date is at your own risk. Store in a cool, dry place. Once opened, consume immediately for best crunch.

    11. GST Invoice and Billing

    In compliance with the Goods and Services Tax Act 2017 and the Consumer Protection (E-Commerce) Rules 2020, we issue a GST-compliant tax invoice with every order. Your invoice will be sent by email within 24 hours of your order being dispatched. The invoice will include all applicable tax details:

    12. Governing Law and Dispute Resolution

    These Terms and Conditions are governed by and construed in accordance with the laws of India. The courts of Ernakulam, Kerala, India shall have exclusive jurisdiction over any dispute arising from these terms or your use of our website.

    13. Consumer Rights

    As a consumer under the Consumer Protection Act 2019, you have the right to
